General Terms and Conditions of Sale (GTCS)

CampervanService - Maintenance, repair and equipment services for motorhomes and converted vans.

Important : CampervanService does not sell online. All services are subject to a appointment and a personalised quote. The contract is formed by acceptance of quotation (handwritten or electronic signature) and/or by the signature of a repair order (RO).

2. Purpose and scope

These General Terms and Conditions govern the services provided by’maintenance, diagnostics, repairs, fitting of accessories and fittings carried out by CampervanService for private clients and business customers.

3. Making an appointment, diagnosis and quotation

    • Every intervention begins with a appointment (workshop and diagnostic.

    • Quote free of charge and valid for 30 days unless otherwise stated. The quotation details labour, parts (new and, where applicable, PIEC - parts from the circular economy), estimated timescales and conditions. Good for agreement« signature» implies full acceptance of these GCS and a firm commitment to the order. Any change to the order must be the subject of a written amendment and may result in a price and/or delivery adjustment.

    • Acceptance signing the quotation (by hand or electronically) andand/or the’repair order (RO) is equivalent to an agreement and authorisation to intervene.

    • Deposit a down payment of 30 to 70% incl. VAT may be required on acceptance of the quotation. In the event of’deposit, the term «deposit» is explicitly mentioned (different legal effects).

4. Repair order (RO)

An RO can be issued and signed before any work is carried out. It specifies the customer's identity, the vehicle (model, registration number, mileage) and any faults reported, authorised work...

5. Prices, display and billing

    • Prices in euros, VAT INCLUDED for consumers ; HT for professionals (VAT not included). Prices displayed in the workshop prevail.

    • Note/invoice a detailed memorandum or invoice is delivered at the latest on payment.

    • Quotation/OR are proof of the services agreed. Any service not provided for in the initial estimate will be subject to a prior agreement (rider, e-mail, SMS or mention on OR).

6. Parts - new and parts from the circular economy (PIEC)

    • In accordance with regulations, customers may opt for PIEC where possible and without risk for safety. This choice is collected in writing before execution and depends on the availability and authorised categories.

    • The exceptions (in particular safety devices, unavailability compatible with the downtime, work under contractual warranty, recalls, etc.) are reminded to the customer.

    • Parts supplied by the customer : acceptance on a case-by-case basis. In this case, no guarantee CampervanService is not liable for any part supplied. additional expenses (inspection, assembly) may apply.

7. Deadlines - downtime - testing

The deadlines are indicative (supplier supply, technical complexity, additional diagnosis). The customer is informed of any extension necessary. The workshop can carry out road tests for diagnosis and post-repair quality control.

8. Delivery - returning the vehicle

The return takes place after whole payment of the sums due. CampervanService has a right of retention on the vehicle until full payment has been made. At the end of a within [7] days after notice of availability childcare costs from [X] €/day can be invoiced.

9. Cancellation / postponement

    • Before execution : the customer can cancel against payment of costs incurred (diagnostics, orders for parts not in stock, return costs, etc.).

    • After start of execution the services provided and parts specifically ordered remain due.

    • Deposit retains its’advance (firm contract) unless stated as «deposit».
    • Toute pièce commandée dans le cadre d’un devis ou d’une demande d’intervention est due en intégralité, et ne pourra pas être remboursée. 

10. Right of withdrawal (contracts concluded remotely or outside the establishment)

CampervanService does not sell not online. However, if a contract is concluded remotely (e-mail, electronic signature) or outside the establishment, the consumer has a 14-day period to withdraw, except :

    • if the service has been fully implemented before the end of the deadline with his express agreement and recognition of loss of rights ;

    • in the event of emergency repair/maintenance requested to its express request.
      If the consumer asks start before the deadline, it will have to pay the proportional share in the event of withdrawal. The standard form can be found in Appendix 1.

11. Terms of payment

11.1. Consumer customers

    • Payment cash on return of the vehicle, by : [CB / bank transfer / cash ≤ €1,000 / other].

    • Delays legal interest and recovery costs for costs actually incurred.

11.2 Professional customers

    • Deadline default : 30 days date of invoice (unless otherwise specified by law in the quotation).

    • Late payment penalties late payment interest will apply in accordance with the provisions of article L. 441-10 of the French Commercial Code, without prejudice to a lump-sum compensation payment of an amount to be defined.

12. Warranties - liability

    • Legal guarantee of conformity on parts sold : 2 years (new or used, according to the law in force). Hidden defects guarantee in accordance with the French Civil Code. The warranty against hidden defects is governed by the provisions of article L. 217-3 et seq. of the French Consumer Code and the provisions of article 1641 of the French Civil Code. New parts are covered by the manufacturer's warranty.

    • Commercial labour warranty

    • Exclusions: normal wear and tear, misuse, lack of maintenance, parts supplied by the customer, unauthorised modifications, external damage (accident, flood, etc.).

    • Liability: CampervanService is liable for proven damage attributable to its fault. Personal belongings left in the vehicle remain in the customer's custody.

13. Complaints - after-sales service

All complaints should be addressed in the first instance to CampervanService ([dedicated after-sales e-mail]). The workshop strives to provide a amicable solution (patches, exchanges, etc.).

14. Consumer mediation (consumer customers)

After first contacting CampervanService in writing, the consumer may refer the matter to free of charge the consumer ombudsman competent :

Governed by the provisions of article L. 612-1 of the French Consumer Code.

15. Personal data

The data collected (making appointments, quotes, invoicing, follow-up) are processed by CampervanService in its capacity as data controller, on the basis of contractual performance and legal obligations. 16. Applicable law - jurisdiction

These terms and conditions are subject to French law. In the absence of an amicable agreement or mediation, disputes will be referred to the courts. competent courts within the jurisdiction of [Bayonne/Pau - please specify]., This is without prejudice to consumer protection rules (domicile of the defendant or consumer).

17. Entry into force - update

Version [date]. CampervanService may update its T&Cs in accordance with legal provisions; the applicable version is the one accepted at the time of the’repair order / quote.
